Please read this Terms of Service ("Agreement", "Terms of Service") document carefully before using 4techman mobile application, available to you through Apple's App Store or Google Play, web application "https://web.4techman.app" and website "https://4techman.app" (referred collectively as "4techman Platform" or "Service") offered by Tessera Multimedia S.A. ("Tessera", "we", "us", "our").
This Agreement sets forth the legally binding terms and conditions for each user's (as defined below) use of 4techman Platform.
If you do not want to be bound by this Agreement, please, do not use 4techman Platform.
By agreeing to this Terms of Service you are also representing that you are of the appropriate legal age to enter into such an agreement.
Access to the platform
The use of the 4techman Platform requires that the user belongs to, or is authorized by, a company/organization registered with the service and with an active subscription. The subscription applies exclusively to companies or organizations and does not allow access to individual users outside of a company/organization. User accounts are created and managed by the company to which the users belong.
An active subscription grants the company the right to access the available features of the platform. The subscription is valid for at least three (3) months from the activation date and may be renewed in writing upon agreement between both parties.
Access to and use of the platform are adjusted according to the available user licenses and the storage space allocated to each company on the server. This storage space is not unlimited and its use is subject to the limits defined by the subscription.
The platform also offers a 7-day trial period (free trial) for new companies or users so they can evaluate the features before activating a subscription. Use of the trial period does not obligate the company to purchase a subscription.
In the event of expiration or non-renewal of the subscription:
- The company's users’ access to the 4techman Platform may be suspended or restricted.
- The company and its user accounts will not have access to data or features until the subscription is renewed.
- No refunds are provided for any unused portion of the subscription.
The platform retains user data in accordance with the service’s Privacy Policy to ensure the protection and security of information.
Users of the platform must not post content that violates laws, intellectual property rights, or codes of conduct, such as illegal or harmful material, offensive messages, or any content considered inappropriate or prohibited.
Modifications to the Service
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We reserve the right to modify the Basic or Premium plan or to transfer any feature from Basic to Premium plan and vice versa.
We reserve the right at any time to activate advertisements to Basic or Premium plan.
We reserve the right at any time to modify the price of Premium. We shall not be liable to you or to third parties for any modification, change of billing, suspension or interruption of the Basic or Premium plan.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
Proprietary rights
You do hereby acknowledge and agree that 4techman Platform and any essential software that may be used in connection with our Service shall contain proprietary and confidential material that is protected by applicable intellectual property rights and other laws.
Any information presented by and through our Service is protected by copyrights, trademarks, patents or other proprietary rights and laws. Therefore, you agree not to alter, modify, lease, rent, loan, sell, distribute, transmit, broadcast, publicly perform and/or created any plagiaristic works which are based on this Service in whole or part.
Disclaimer of warranties, limitation of liability
We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free.
We do not guarantee that synchronization of data between mobile and web application will be provided continuously and without problems.
You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and services delivered to you through the Service are (except as expressly stated by us) provided "as is" and "as available" for your use, without any representations, warranties or conditions of any kind, either expressed or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Tessera, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the services or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to this page. It is your responsibility to check it periodically for changes. Your continued use of or access to the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
